Terms of Service

These Terms of Service ("Terms") govern your use of acreday.com, app.acreday.com and related services (the "Services") operated by AcreDay. AcreDay is an online marketplace in the United States that connects landowners ("Hosts") with people who rent land by the day ("Guests") for camping, hunting, events, storage, construction yards and similar uses. By using the Services you agree to these Terms.

1. Eligibility and Accounts

You must be at least 18 and able to form a binding contract. You agree to provide accurate information, keep your credentials secure, and are responsible for activity on your account.

2. Listings

Hosts are responsible for their listings, including accuracy, pricing, availability, rules, and compliance with applicable laws, permits, zoning, hunting and safety regulations, and insurance. Hosts must have the right to rent the land listed. AcreDay may remove listings that violate these Terms.

3. Bookings

A booking is a contract between Host and Guest. Every booking is for the whole listed property, private and exclusive to the Guest for the booked period; land is never shared with other Guests or divided into campsites or spots. Bookings are priced only by full 24-hour days, with a minimum of one (1) day for every use and activity; there is no hourly pricing. Each day begins at the check-in time the Guest selects and ends 24 hours later (for example, check-in Saturday at 10:00 AM, check-out Sunday at 10:00 AM). Multi-day bookings consist of consecutive 24-hour days. Hosts review and approve each booking request. Guests must follow the listing rules and applicable laws, use the land only for the booked purpose and dates, and leave it in the condition found. AcreDay is not a party to that contract and does not own, operate or control any listed property.

4. Fees and Payments

Prices per 24-hour day are set by Hosts. AcreDay charges Guests a service fee and charges Hosts a commission on each booking. Before you pay, checkout shows the full total, including the service fee, and nothing is added afterward. Payments are made online through Stripe secure checkout, and Host payouts are sent to the Host's bank account through Stripe; you agree to Stripe's applicable terms. Hosts are responsible for taxes on their earnings unless otherwise required by law.

5. Cancellations and Refunds

Cancellations and refunds follow the cancellation policy shown on the listing at the time of booking. Service fees may be non-refundable except where required by law. AcreDay may issue refunds or cancel bookings in cases of safety concerns, fraud, or listings that are materially not as described.

6. Prohibited Conduct

You may not use the Services for unlawful, unsafe or fraudulent purposes, circumvent payments through the platform, harass other users, or interfere with the Services.

7. Disclaimers and Limitation of Liability

The Services are provided "as is" without warranties of any kind. Use of land carries inherent risks, and you assume those risks. To the fullest extent permitted by law, AcreDay is not liable for indirect, incidental, special, consequential or punitive damages, or for personal injury or property damage arising from any listing or booking, and our total liability is limited to the greater of the fees you paid AcreDay in the 12 months before the claim or $100.

8. Indemnification

You agree to indemnify and hold AcreDay harmless from claims arising from your listings, bookings, use of land, or violation of these Terms.

9. Termination

We may suspend or terminate accounts that violate these Terms. You may close your account at any time.

10. SMS Terms

Program name: AcreDay Notifications.

Description: By opting in, you agree to receive text messages from AcreDay for customer care and booking notifications (such as booking confirmations, reminders, and replies to your support requests).

Message frequency varies. Message and data rates may apply.

Reply STOP to cancel at any time; you will receive one confirmation message and no further messages. Reply HELP for help, or contact [email protected].

Carriers are not liable for delayed or undelivered messages.

Consent to receive text messages is not a condition of purchase.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction.

12. Changes

We may update these Terms and will post the new version with an updated effective date. Continued use means you accept the changes.
